Probate is a process in which the court takes control of a deceased individual’s estate at the time of their death. This process is lengthy and expensive, however, it is only initiated if the decedent left an estate with a value over $100,000 and did not have a trust in place. A Probate can cost 5-10% of the gross estate and the process can take anywhere from 6 months to 2 years from the time of the individual’s death.
